In our opinion, the value of arbitration as a legal tool is exaggerated, although it can be useful in certain very limited circumstances. The mandatory nature of the process, its expense, and length of time needed to obtain a result makes arbitration a less than optimal tool in most cases. Litigation can frequently produce a satisfactory outcome more quickly and at a lower cost than arbitration.

Early Neutral Evaluation
