Employment Development Department Audits

Various state and federal agencies have the ability to come to your business and examine your books. The EED is one of these agencies and usually examines unemployment insurance and state disability compliance. Every quarter, an employer is required to disclose to the EED payroll and wage information. Independent contractor misclassification is a growing issue and mistakes can result in an audit. If an employer has not paid sufficient employment taxes due to a misclassification, the employer may be subject to penalties. We help employers get the right documentation and will interact with the EDD directly on your behalf. Employers have the right to a hearing, and we represent our clients at these hearings to limit any penalties or exposure.

Labor Commissioner and Workers' Compensation Audits

The labor commissioner responds to employees who claim wage, hour and overtime violations. The Division of Labor Standards Enforcement (DLSE) has an enforcement arm to go into a business and look at records related to workers' compensation and payroll practices. The labor commissioner can look at time records and payroll records to make sure employees have been paid correctly. An employer can be issued penalties, and even daily penalties, if they are in violation or do not have the correct and mandated workers' comp insurance.

OSHA Investigations

Another enforcement agency is the Occupational Safety and Health Administration, or OSHA. OSHA protects employees by regulating for a safe work environment. If you are subject to an OSHA investigation and are accused of violations, you have the right to appeal this decision and sometimes negotiate fines.
