Whistleblower Protection Against Wrongful Termination
The Health and Safety Code Section 1278.5 prohibits discriminatory treatment against employees who advocate for patient safety. Employees found to have been unlawfully retaliated against are usually entitled to reinstatement, lost wages, benefits, and oftentimes attorney's fees. In some cases, there is a rebuttable presumption of retaliation if an employee is terminated within 120 days of filing a grievance or complaint.
