The Uniformed Services Employment and Reemployment Rights Act of 1994 (USERRA), and the California Military and Veterans Code prohibit discrimination on the basis of serving in the armed services. These acts require employers to allow employees time off to serve in the uniformed services, and guarantee the right to reemployment upon conclusion of the term of service. USERRA and the California Military and Veterans Code apply to virtually all employers, including federal, state (with exceptions), and local government.

Rights Under USERRA and California's Military and Veterans Code
The amount of time an employee can be absent from work, as well as the minimum length of reemployment, are statutorily mandated by USERRA and California’s Military and Veterans Code. Failure to abide by either law can result in significant exposure to unwary employers.
Depending on the size of the employer, non-serving employees may also be entitled to temporary leaves of absence when an employee’s spouse returns to work from active duty.
